These Terms of Service ("Terms") govern your use of the Hyperscalers iOS application ("the App") and the related website at hyperscalers.lilinsystems.xyz ("the Site"), both operated by Lilin Systems ("we", "us", "our"). By installing, opening, or using the App or Site you agree to these Terms.

1. The Service

Hyperscalers is an editorial research tool that visualises capital expenditure flows across the AI infrastructure supply chain. It surfaces publicly available market data, hand-curated editorial commentary, and AI-generated summaries.

Hyperscalers is not a financial advisor, broker, or fiduciary. Everything in the App is editorial commentary intended to help you form your own view. Nothing in the App constitutes a recommendation to buy, sell, or hold any security. Past performance does not indicate future results.

2. Eligibility

You must be at least 13 years old to use the App. If you are between 13 and the age of majority in your jurisdiction, you may only use the App with the consent of a parent or guardian.

3. Subscription — Hyperscalers Pro

The App offers free access to a limited subset of features and a paid "Hyperscalers Pro" subscription that unlocks the full product.

Pricing. Hyperscalers Pro is offered as a weekly auto-renewing subscription. The price displayed in the App and on the App Store at the time of purchase governs. Prices may vary by region and may change over time, with notice before renewal where required by law.

Billing. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Apple manages billing; subscription management is available in Settings → Apple ID → Subscriptions on your device.

Free Trials and Introductory Offers. If a free trial or introductory price is offered, it is non-transferable and limited to one per Apple ID. The full price applies after the trial ends unless you cancel before then.

Refunds. Refund requests for App Store subscriptions are handled by Apple under Apple's policies. We do not process refunds directly. You can request a refund at reportaproblem.apple.com.

4. AI-Generated Content

The App includes an "Explain in 30 seconds" feature that generates short summaries using a large language model (currently Anthropic Claude). These summaries are produced automatically based on live market data and editorial context.

AI-generated content may contain errors, omissions, or out-of-date information. We take reasonable care to ground summaries in cited data, but you should not rely on them as a substitute for your own research or for advice from a licensed professional.

5. Third-Party Data Sources

Market data displayed in the App is sourced from third parties including Finnhub, Financial Modeling Prep, and Yahoo Finance. We do not warrant the accuracy, timeliness, or completeness of any data. Prices may be delayed by up to four hours.

External links (e.g. "source" links on bottleneck notes, "View on Yahoo Finance" buttons) open content owned and operated by third parties. We are not responsible for the content, accuracy, or practices of any third-party site.

6. Acceptable Use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Scrape, mirror, or republish the App's editorial content without permission
  • Use the App to violate any law or third-party right
  • Attempt to interfere with the App's security or availability
  • Resell access to your Pro subscription

7. Intellectual Property

The App's source code, editorial content (including the taxonomy, bottleneck notes, and "why this matters" copy), visual design, and the name "Hyperscalers" are owned by Lilin Systems. Third-party data and editorial sources cited within the App remain the property of their respective owners.

Limited licence: while your subscription is active, you may use the App for personal, non-commercial research.

8. Disclaimers

The App is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, secure, or error-free, or that any defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, Lilin Systems will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunity, arising out of your use of the App — even if we have been advised of the possibility of such damages.

In no event will our total liability for any claim arising out of or relating to these Terms or your use of the App exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) USD 50.

10. Indemnity

You agree to indemnify and hold harmless Lilin Systems against any claims, damages, or expenses arising out of your breach of these Terms or your misuse of the App.

11. Termination

You may stop using the App at any time. We may suspend or terminate your access at any time for breach of these Terms.

If your subscription is terminated, you retain access to Pro features through the end of the current paid period. Cancellation does not entitle you to a refund for the unused portion of the period unless required by law.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated through the App or via the Site. Continued use of the App after a change indicates acceptance of the revised Terms.
